What independent means here, and how we check that it is true.
Why we check
A person who is really an employee cannot be called a contractor to get around employment rules. In Minnesota, an employer can be fined up to $10,000 for each worker who is misclassified (Minn. Stat. § 181.722). Owners who knowingly or repeatedly misclassify can be held personally liable. Last checked September 30, 2026.
What we check before work starts
- Who decides how the work is done
- Whether you can work for other clients
- Who pays for tools and expenses
- Whether you are paid for a result or for hours
- Whether you run your own business
These are examples. The right test depends on the law that applies, and we ask employment counsel when it is not clear.
What you can expect
You decide how and when you do the work. We tell you the result we need. Terms are set in your agreement after the check.
If a role does not pass the check, we will tell you. We will not offer it as a contractor role.
